Terms of Use
Last updated: July 2, 2026
On this page
These Terms of Use (“Terms”) govern your use of mysparkhouse.org and our forms, booking, and communication tools (together, the “Services”). By using the site or registering for a program, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
1. Acceptance of These Terms
By accessing the site, submitting a form, registering for a program, or otherwise using the Services, you accept these Terms on your own behalf and, if you are acting for a household, school, or organization, on its behalf. If a separate written agreement (for example a program agreement or partnership agreement) exists between us, that agreement controls where it conflicts with these Terms.
2. About & Eligibility
mysparkhouse.org is operated by Spark House LLC (“Spark House”), a New York limited liability company operating youth-arts programs, based in New York City, New York. We create programs, workshops, and creative opportunities for young people and their communities. Some programs are for minors and require a parent or guardian to register on the young person’s behalf and provide any required permissions. If you register on behalf of a minor or an organization, you confirm you are authorized to do so and to accept these Terms.
3. Acceptable Use
You agree to use the site lawfully and not to:
- attempt unauthorized access to the site, its data, or its systems;
- interfere with or disrupt the site’s operation or security;
- harvest other users’ data, or scrape the site at scale;
- transmit malicious code, spam, or fraudulent content;
- impersonate anyone, or harass or abuse anyone through our forms, email, or phone lines;
- use the Services to violate any law or third-party right.
We may suspend or terminate access for any violation, and may report unlawful activity to the authorities.
4. Programs & Registration
Programs, classes, and events are described and registered through this site and our scheduling tools. Details such as dates, capacity, age ranges, and requirements are shown at the time of registration and may be subject to availability. A registration is confirmed only when we accept it and any required information or permissions have been provided. You are responsible for giving accurate information and for following the guidelines, safety rules, and staff instructions for any program you or your child participates in. Where a program has a fee, the amount and any terms are shown at the time of registration.
5. Changes & Cancellations
| Situation | What happens |
|---|---|
| You need to change or cancel a registration | Contact us as early as you can; we’ll do our best to reschedule or free up the spot for someone else. |
| A program is full or under-subscribed | We may waitlist a registration or reschedule/cancel a program; we’ll notify you and, for any paid program, address fees fairly. |
| We change program details | We may adjust dates, format, staffing, or location when needed; we’ll communicate material changes as early as possible. |
| Health, safety, or conduct concerns | We may decline or end participation to keep participants and staff safe. |
We aim to be fair and reasonable in every case — if something is not working, email us.
6. Intellectual Property
The site, its design, code, text, graphics, curriculum, and materials are owned by Spark House or its licensors and are protected by intellectual-property law. You may not copy, redistribute, or create derivative works from our content without our written permission, except for personal, non-commercial use of materials we provide to program participants for that program.
7. Your Content
You keep ownership of the content and materials you provide (for example, information you submit through a form or work a participant creates). You grant us a limited license to use what you submit only as needed to deliver and administer the Services and the program you registered for. You confirm you have the rights to any content you give us and that it does not infringe anyone’s rights or break any law. Any use of a participant’s photo, artwork, or likeness for promotion is handled separately and only with appropriate consent.
8. Third-Party Services
The Services rely on third parties (e.g. Amelia for booking, WPForms for forms, Resend for email, SiteGround for hosting, Google for analytics). Your use of those features may also be subject to their terms, and we are not responsible for their acts or omissions. Links to third-party sites are provided for convenience and are not endorsements.
9. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or secure. Programs are delivered with reasonable skill and care, but we do not guarantee specific outcomes or results. Nothing on this site is medical, legal, financial, or other professional advice for your specific situation — see our Disclaimer.
10. Limitation of Liability
To the fullest extent permitted by law, Spark House will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the three (3) months before the claim, or US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Spark House from claims, damages, and reasonable costs (including legal fees) arising from your misuse of the Services, your content, or your breach of these Terms or of any law or third-party right.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing any claim, we agree to first try in good faith to resolve it informally by email for 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York, New York, and you consent to their jurisdiction. Each party keeps the right to seek injunctive relief for intellectual-property or unauthorized-access matters.
13. Term, Termination & Changes
These Terms apply while you use the Services. We may suspend or end access if you breach them. We may update these Terms; the “Last updated” date will change and, for material updates, we will provide more prominent notice. Continued use after a change means you accept the updated Terms. If any provision is found unenforceable, the rest remains in effect.
